Terms and Conditions of Use – HarvCV

By accessing, registering, or using HarvCV.com and any of its versions, modalities, or modules, you expressly accept these Terms and Conditions of Use. If you do not agree with any part of them, you should refrain from using the service.

1. Service Description

HarvCV is a digital platform for creating, optimizing, evaluating, and managing professional resumes, designed under a non-negotiable guiding principle:

Privacy, information security, and data control belong to the user.

HarvCV offers the following modalities:

• HarvCV Free: free version, no mandatory registration, focused on resume creation and essential features. Information is stored exclusively locally on the user's device.
• HarvCV Pro: premium version that includes encrypted cloud storage, advanced templates, AI tools, extended downloads, and additional features.
• HarvCV Enterprise: a modality for companies and organizations that provide redeemable vouchers so their collaborators can access HarvCV Pro.
• HarvCV Education: a modality for educational institutions, foundations, and non-profit organizations that provide redeemable vouchers to students, beneficiaries, or members.
• Luxia AI: an AI-based assistance module aimed at interview preparation and communication improvement.

2. Registration, User Account, and Access

To access HarvCV Pro, either through direct purchase or via Enterprise/Education vouchers, you must create an account using a valid email address.

The user is responsible for:

• Maintaining the confidentiality of their credentials.
• Any activity carried out under their account.

HarvCV is not responsible for unauthorized access resulting from negligent use of credentials by the user.

3. HarvCV Enterprise and HarvCV Education – Vouchers and Privacy

3.1. Voucher Conditions

• Vouchers issued under HarvCV Enterprise and HarvCV Education are valid for a maximum of twelve (12) months from their issue date.
• If the voucher is not redeemed within that period, it expires automatically, with no possibility of reactivation, extension, or refund.
• Redeeming a voucher immediately activates the associated HarvCV Pro membership.
• The membership period starts counting from the exact moment of redemption.
• Example: a thirty (30) day voucher starts its full validity at the moment of redemption, regardless of actual use.
• Once the period begins, it cannot be paused, suspended, or extended.

3.2. Access Limits and Data Protection

Companies, educational entities, foundations, and NGOs participating in HarvCV Enterprise or HarvCV Education programs expressly accept that:

• They have no access, under any circumstance, to the content of resumes created by users.
• They may not view, download, analyze, request, or process generated CVs, documents, or texts.

The only accessible personal data is:

• The email address used to redeem the voucher.
• Statistical and aggregated information about voucher usage.

HarvCV may provide usage reports, which may include:

• Number of vouchers redeemed.
• Number of resumes created.
• Emails associated with redemption.
• Statuses, dates, and voucher consumption.

These reports do not include resume content or additional sensitive data.

4. Intellectual Property

The software, code, design, templates, interfaces, brand, and materials associated with HarvCV are HarvCV's intellectual property. Resumes and documents generated are the exclusive property of the user. HarvCV does not acquire exploitation rights, assignment, or commercial use over generated content.

5. Acceptable Use and Prohibited Conduct

The user agrees to use HarvCV legally and responsibly. It is prohibited to:

• Share paid access without authorization.
• Perform reverse engineering, scraping, unauthorized mass automation, or system manipulation.
• Use the platform for illegal, fraudulent, or malicious activities.
• Attempt to breach the security, confidentiality, or availability of HarvCV systems or third parties.

Noncompliance may result in immediate suspension or cancellation of the account, with no right to a refund.

6. Payments, Subscriptions, and Expiration

HarvCV Pro payments are processed through external providers acting as Merchant of Record.

6.1. Expiration of the Pro Membership

When a HarvCV Pro membership expires, whether due to:

• Non-renewal.
• End of the contracted period.
• Or expiration of a membership obtained via voucher.

The user's account automatically returns to a HarvCV Free status, keeping the account, but with the following conditions:

• All Pro features are fully disabled.
• The user can only operate with the functions available to authenticated Free users.

7. Third-Party Services

HarvCV uses third-party services, including AI providers, encrypted storage infrastructure, and analytics tools. Continuous availability or uninterrupted operation of these services is not guaranteed.

8. Use of Artificial Intelligence

HarvCV uses AI infrastructure through Lovable AI Gateway, which processes requests via external AI providers, including Google Gemini.

The use of AI within the platform is governed by the following conditions:

• Prompts and responses are transmitted under a "pass-through" model and are not stored by Lovable.
• Lovable does not use the data to train AI models.
• External AI providers (including Google Gemini) process the information under their commercial APIs, which do not use customer data to train models, in accordance with their corporate privacy policies.
• Identifiable personal data is never used to train AI models.
• HarvCV does not introduce additional personal information into AI processes beyond what the user voluntarily provides for the requested functionality.

9. Luxia AI – Scope, Privacy, and Limitations

9.1. Use of Luxia AI in HarvCV Pro – Temporary Storage

When using Luxia AI with an active HarvCV Pro membership, conversations are stored temporarily and encrypted in HarvCV's database solely to allow continuity of the conversation between sessions. Conversations are retained only while the user keeps the conversation open. The user has an explicit control to indicate that the conversation has ended.

When marking the conversation as completed:

• The conversation is closed permanently.
• All content is completely deleted from HarvCV's database.
• There are no backups or recoverable versions.
• Deletion is irreversible.

9.2. No Analysis, No Monitoring, and User Control

HarvCV expressly states that:

• It does not analyze, review, or monitor conversations held with Luxia AI.
• It does not create backups of conversations.
• It does not use conversations for model training, user profiling, or secondary purposes.
• Conversations are not shared with companies, educational institutions, foundations, NGOs, or third parties.

The user retains full control over the permanent deletion of conversations.

9.3. Nature and Limitations of Luxia AI

Luxia AI is a support and practice tool. It does not guarantee employment, salary, or hiring results, nor does it constitute professional, legal, psychological, financial, or human resources advice. It may generate errors, inaccuracies, biases, or inappropriate responses. The user is responsible for verifying and adapting generated content.

9.4. Misuse of Luxia AI

Misuse includes, among others:

• Prompt injection.
• Bypassing security filters.
• Use for spam, fraud, or illegal activities.

In these cases, HarvCV may suspend or cancel the account without prior notice and without the right to a refund.

10. Limitation of Liability

To the maximum extent permitted by applicable law, HarvCV will not be responsible for damages arising from the use or inability to use the service, technical failures, user decisions, or AI-generated content.

Use of the service is solely at the user's responsibility.

11. Modifications

HarvCV may modify these Terms and Conditions at any time. Continued use of the service implies acceptance of the current version.

12. Governing Law

These Terms and Conditions are governed by general principles of law and by applicable legislation on digital services and personal data protection, without prejudice to mandatory rules that may apply according to the user's country of residence.

13. Minors

HarvCV recognizes the importance of enabling career guidance and professional training processes in a safe environment, in accordance with principles of digital protection for minors and the best interests of the child.

13.1. Minimum Age

Use of HarvCV is subject to the following age restrictions:

• HarvCV Free: 14 years or older.
• HarvCV Pro: 16 years or older.
• Luxia AI: Designed for ages 18+*

*Educational Exception: Minors aged 16–17 may access Luxia AI exclusively through Enterprise or Education vouchers, under the conditions set in section 13.3 and only if the providing entity has explicitly enabled that functionality for the corresponding voucher.

13.2. Use of HarvCV Free (Minors)

Minors may use HarvCV Free, which operates with 100% local storage on the user's device and does not require cloud registration. Supervision by responsible adults is recommended, especially in educational or vocational guidance contexts.

13.3. Vouchers for Minors (Enterprise / Education)

When educational institutions, foundations, or NGOs provide HarvCV Pro access vouchers to minor beneficiaries (16–17 years), the following special protection conditions apply:

a) Prior Information

HarvCV strongly recommends that the providing entity inform beneficiaries and, when possible and according to its internal protocols, their parents or legal guardians about:

• Access to conversational AI tools.
• Encrypted cloud storage of information.
• The nature and scope of job preparation and interview simulation features.
• Available privacy controls and data deletion.
• Access to the Privacy Policy and data processing policies applicable to minors.

b) Institutional Control of Luxia AI

Voucher-providing entities have technical administrative controls that allow them to:

• Enable or disable access to Luxia AI individually for each voucher.
• Set default configurations according to their institutional policies (example: Luxia AI disabled by default for all beneficiaries under 18).
• Modify these permissions at any time during the voucher's validity without affecting other functionalities.

By default, Luxia AI functionality will be issued in a "DISABLED" state for all vouchers managed by the Providing Entity. It will be the exclusive and discretionary responsibility of that entity to enable this function manually or in bulk, assuming the corresponding supervision duties.

When Luxia AI is disabled by institutional decision, the voucher beneficiary retains full access to all other HarvCV Pro features, including premium templates, encrypted cloud storage, multi-format downloads, and CV optimization.

This functionality allows each institution to implement its own policies for minor protection and responsible use of artificial intelligence, adapting to its regulatory frameworks, cultural contexts, and parental authorization requirements.

c) Enhanced Individual Acceptance (Luxia AI)

In cases where the providing entity has enabled Luxia AI access for a voucher used by a minor, when attempting to access that functionality for the first time, the user must accept Luxia AI Specific Terms of Use stating expressly:

• To be 18 years or older, or
• To be between 16–17 years old and have informed, explicit parental authorization to use conversational AI tools.

HarvCV does not proactively verify this declaration, but it is recorded and may be required in case of dispute or at the request of legal representatives.

d) Parental Revocation Right

Parents or legal guardians of minors may exercise the following rights at any time by contacting [email protected]:

• Deactivate access to Luxia AI (while maintaining access to other HarvCV Pro features).
• Request information about overall account usage, including access dates and features used (without access to specific document or conversation content, in compliance with user privacy).
• Full closure and deletion of the minor's account.
• Confirmation of applicable data retention and deletion policies.

HarvCV will process these requests within a maximum of 72 business hours from receipt, prioritizing the best interests of the minor and the exercise of parental responsibility.

e) Scope of Responsibility and Roles

Role of the Providing Entity

The educational institution, foundation, or NGO that provides vouchers acts as a facilitator of the benefit, without assuming the role of legal guardian, guarantor of individual use, or being responsible for daily supervision of the minor's activity on the platform.

• Decide whether to enable Luxia AI for minor beneficiaries.
• Implement their own information processes and, when appropriate according to their policies, parental consent.
• Communicate voucher usage conditions to beneficiaries.

Role of HarvCV

HarvCV implements technical protection measures, including:

• Granular access controls by functionality.
• Content filters in AI tools.
• Responsible use limits.
• Warning and enhanced acceptance processes.
• Permanent conversation deletion mechanisms.
• Contact channels for exercising parental rights.

HarvCV does not assume the role of parental supervisor nor guarantee the use each minor makes of the tools, acknowledging that such supervision primarily belongs to the family sphere.

Family Responsibility

Effective supervision of minors in digital environments, including the use of artificial intelligence tools, primarily belongs to parents or legal guardians, who retain parental responsibility for the minors' online activities under their care.

13.4. User Declaration

When registering for HarvCV Pro, redeeming a voucher, or accepting Luxia AI Specific Terms, the user declares, under their sole responsibility:

• To comply with the age requirements established in section 13.1.
• If under 18, to have the authorization of their legal representatives when applicable.
• To have read and understood the limitations, scope, and nature of artificial intelligence tools.
• To have accessed and understood the applicable Privacy Policy, including the processing of personal data of minors.

HarvCV reserves the right to request age verification or proof of parental authorization if there are founded and reasonable indications of noncompliance with these conditions.

13.5. Preventive Recommendation

In case of doubt about the beneficiary's age, applicable parental authorization requirements, or the suitability of HarvCV Pro functionalities for the minor's context, parents, guardians, or providing entities are strongly encouraged to contact [email protected] before redeeming the voucher or first accessing the platform.

The HarvCV team is available to provide guidance on:

• Available functionalities by age.
• Parental controls and supervision.
• Recommended privacy configurations.
• Data deletion processes.
• Best practices for safe use by minors.
